Beatles-Tribute-Band-UK and AlphaEntertainment (the "Website") are an online information, communication, advertising and sales service provided by Alpha Entertainment, Southampton, Hampshire, United Kingdom. Your access and use of the Website is subject to your compliance with the terms and conditions set forth below, including all exhibits hereto. Please examine this document carefully before accessing or using the Website. By accessing or using the Website, you agree to be legally bound by the terms and conditions set forth below. You may not access or use the Website should you not want to be bound by these terms and conditions. This Agreement may be modified at any time, and any such modification shall be effective immediately upon posting of the modified agreement. By your access and use of the Website you agree to regularly review this Agreement and shall be conclusively bound by any such future modifications.

A) Copyright, Licenses and Idea Submissions. The entire contents of the Website are copyrighted under United Kingdom copyright laws. Alpha Entertainment is the exclusive owner of the copyright. Most of the content found on this site has been submitted by third party information providers, partners and sponsors. Any copying, redistribution, publication or retransmission of any portion of Website material, is strictly prohibited without the express written permission of Alpha Entertainment or any third party information provider to the Website. You further agree to grant to Alpha Entertainment a non-exclusive, royalty-free, worldwide, perpetual license, with the right to sublicense, to reproduce, transmit, distribute, create any derivative works of, publicly use or display any materials or other information (including, but not limited to, ideas, concepts or techniques for new or improved services and products) you publish to the Website by any means or by any media now known or hereafter developed. You further agree that any such communication you make to the Website (whether information, feedback, data, questions, comments, suggestions or the like) shall be deemed not to be confidential. Policies of Operation

While using the Website you may not:

(I) post or transmit any message anonymously or under a false name;

(II) post or transmit any unlawful, threatening, abusive, libellous, defamatory, obscene, pornographic, profane or otherwise objectionable information of any kind, including without limitation any transmission constituting or encouraging conduct that would constitute a criminal offence, give rise to civil liability, or otherwise violate any local, national or international law. It is not Alpha Entertainment’s intent to discourage you from taking controversial positions or expressing vigorously what may be unpopular views or opinions; Alpha Entertainment does, however, reserve the right to take such action as it deems appropriate in instances where the Website is used to disseminate statements which are deeply and widely offensive and/or harmful in nature;

(III) post or transmit any message which discloses private or personal matters concerning any person;

(IV) post or transmit any information, file or software that contains a virus, cancelbolt, worm, Trojan Horse or any other contaminating or destructive features;

(V) post or transmit any message, data, image or program that would violate the property rights of others, including unauthorized copyrighted text, images or programs, trade secrets or other confidential proprietary information, and trademarks or service marks used in an infringing fashion;

(VI) interfere, in any way, with other users of the Website;

(VII) post or transmit charity requests, petitions for signatures, chain letters or letters relating to pyramid schemes, job applications, CV’s or Job Specifications;

(VIII) post , list or transmit articles, which are inappropriate according to the description of the group affected;

(IX) post or transmit your direct contact details to bands or customers of this site. Alpha Entertainment reserve the right to suspend accounts of customers or bands if they are found to be in breach of this condition of using the website;

(X) continuously email or "spam" the servers, URLs, email addresses of Alpha Entertainment or it’s members, clients or contributors;

Alpha Entertainment reserves the right to withhold any communication, email advertisement or comment it receives from publication within the website.

In deciding whether to accept your order we may use the information you have given to us, or we already hold about you, or which we receive from any enquiry we may make with Early Warning Uk Ltd, to confirm your identity. Early Warning Uk Ltd will check any details we disclose to them against any data bases (public or private) to which they have access and will keep a record of that check. Early Warning UK Ltd will also retain this information and may use it in the future to assist other companies with identity verification. This assists us to protect you and us from fraudulent transactions.

General Statement of Trading Practice

Alpha Entertainment strives to provide you with up-to-date and accurate information in our web sites. However manufacturers reserve the right to amend or alter the specific features of their products without notice and so any information that we provide in our web sites is on a ’best efforts’ basis. Please refer to the manufacturers’ web sites for the latest information on any product or ask us to research your specific requirements for you.

Our aim is to build long-term relationships with satisfied customers through excellent Customer Service, Technical Support, Competitive Pricing and fair Payment Terms for all, whether first time buyers or regular customers.

We do not make recommendations to purchase any product but give independent, honest opinions, advice and as much information as you require to help you make the right decision.

We operate a never beaten on price policy - if you can find the same product cheaper elsewhere please tell us so that we may have the opportunity to match that price.

Prices, offers and other manufacturer deals are often available that can affect market pricing and although we aim to be aware of them all we cannot always be up to date with every offer available. But if you tell us about it we can usually get it for you.

Customer Service

We track all orders placed with us until they have been delivered and a Proof Of Delivery has been received by us.

As part of this process we will keep you informed by email or telephone of all and any issues that may arise with order shortages due to items being out of stock or courier problems.

Please ensure that delivery addresses contain all and any information that will help us to help the courier to find you. We are happy to add in delivery advice such as "at end of narrow lane past the pub" if this helps you receive your goods on time and when expected.

We check every order shipped every morning with our couriers and will advise you on the morning of delivery that the goods are confirmed as being ’out for delivery today’ and of course we will inform you if they are not!

Technical Issues

We will be pleased to check any specific technical issue or product feature with the manufacturers on your behalf before any sale is completed in order to ensure that a product satisfies your requirements.

Manufacturer’s warranty varies so please check this with the manufacturer to ensure that you are satisfied with the level of service being offered. Warranty upgrades and extensions are usually available for sale within a specific time period after the sale - please check this with us at time of sale.

We will provide details of the manufacturers’ technical support services and contact numbers for any item you buy from us and will do everything in our power to help you achieve a satisfactory resolution of your technical issue through the manufacturers’ helplines. This is in your best interests as we cannot have intimate knowledge of every product we sell and cannot offer specific technical support that is guaranteed to be as up to date and accurate as the manufactuers front line and second level support staff. But if we can help you ourselves we will - we are always happy to help!

Warranties vary from swap out to back to factory for repair to on-site engineer visits and we will advise you accordingly when you contact us. Any engineering based technical issues will need to be referred to the manufacturers’ help desks under the terms of the product’s warranty conditions, as they have specialist engineering knowledge of their products that is not generally available to us.

We are not responsible for any software application or networking issue that you may encounter as a result of adding new equipment to your systems. All system requirements or specific printer use, both current and planned, should be discussed with us at the time of purchase to ensure that we can supply you with the correct products that are fit for the purpose that you describe to us.

Technical issues that arise due to changes to your systems, software applications, operating systems, network or other technologies that take place after the date of purchase are not the responsibility of Alpha Entertainment, however we will help you get advice and assistance from the manufacturers in such a circumstance.

Alpha Entertainment cannot be held responsible for failing to satisfy any specific feature, networking, software application, operating system or other technical requirement that you have unless you tell us what it is at time of sale.

Contract of Sale

All contracts of sale are completed by phone, fax or Customer Order Update email - web created orders are received but are not completed on-line and are based upon these Terms and Conditions of trade. This allows you and us to ensure that the goods you are ordering are what you require and to confirm the delivery information.

Payment Terms & Fraud

IT MAY APPEAR THAT WE ARE UNECESSARILY FOCUSING ON FRAUD IN THE FOLLOWING STATEMENTS BUT WE RECEIVE 5  ATTEMPTS TO PURCHASE GOODS FRAUDULENTLY ON AVERAGE PER DAY! WE ARE VERY FOCUSED ON FRAUD PREVENTION AS A RESULT.

Fraudulent Internet purchasing is growing. The merchant ( Alpha Entertainment ) has no protection when a stolen credit card is used to purchase goods therefore we credit  and fraud check every order placed and report all incidences of attempted stolen card usage and identity theft to the police and add such attempted fraudsters information to the EarlyWarning database. We aim to protect both ourselves and our genuine customers at all times and will alert the genuine owners of stolen credit cards or stolen identities that their credit is being used fruadulently. We have assisted victims of identity theft with their subsequent police investigations on a number of occasions.

As a result of the high incidence of online fraud, we will have to ask for proof of identity at the Delivery Address for all plasma and projector orders placed before shipping the goods. This also applies to all high value orders for printers, monitors and consumables regardless of the payment type.

Standard payment terms are payment at time of order by credit card, BACS, CHAPS or cheque. We do not accept over the counter payments at banks due to the increasing incidence of the fraudulent use of stolen cheques. For orders placed from outside of the UK payment can only be accepted by Electronic Transfer or a Bankers Draft from a business account.

Goods paid for by credit card can only be delivered to the cardholder’s address unless specific proof is provided that the cardholder is buying the goods for a company or employee who lives where the goods are to be shipped.

All credit card details are destroyed and are never stored electronically by Alpha Entertainment.

All attempted fraud is reported to the card issuers who will cancel the card immediately, to the issuing bank of any fraudulent cheques, to EarlyWarning and to the police.

Payment by Credit Card for Orders Placed in our Web Site 

You may elect to place an order in our web site and make payment by credit card at time of placing the order. In this instance the 'payment' is not received by us at time of placing the order. The card transaction process - whether through our web site or over the telephone - is as follows:

1. The card details are entered into a secure third party system, in this case Protx.

2. Protx contacts the card issuer with the card details and requests a match to the cardholder's details held by the card issuer. Protx also requests confirmation that the amount entered is available on the card's account balance.

3. Protx confirms to the person entering the card details via our web site or via our terminals by our staff that the transaction has been accepted or declined by the card issuer.

4. Protx confirms to Alpha Entertainment that the card issuer has accepted or declined the transaction.

5. If the transaction has been accepted by the card issuer, Alpha Entertainment sends an automated email to the email address given confirming that the transaction has been approved, confirming the goods that have been ordered, their price, the delivery charges and the VAT charge. This email also confirms that we will contact the purchaser to finalise the delivery details.

At this stage no money has been debited from the cardholder's account and the Contract of Sale is NOT completed.

Alpha Entertainment staff will now investigate the card transaction for potential fraud and will communicate with the purchaser about any errors in the order and confirm the delivery details. Once we are satisfied that both the order and the payment transaction are correct, we will release the deferred payment and take the funds. Fraud checking may include phoning, emailing or faxing the purchaser to request further proof of identity or to otherwise satisfy ourselves that the cardholder and the purchaser are the same person.

The Contract of Sale is completed when we send a Customer Order Update email to the purchaser that confirms the full details of the order placed as well as any relevant stock or delivery information.

If we cannot supply the goods or do not wish to complete the transaction for any reason, we will void the card transaction with Protx and therefore decline to accept payment. In this instance no money will be debited from the cardholders account and no Contract of Sale has been entered into.

To be clear - payment is not made at the point of the card details being entered into our web site and the automated email is sent confirming that the transaction has been approved by the card issuer. Payment is made at the point that an Alpha Entertainment staff member releases the deferred payment and accepts the funds.

If at any time you wish to cancel a credit card payment you may do so by contacting us on 07973 428 326 and it can be voided by any staff member.

Credit Terms

30 Days credit terms are given automatically to Government bodies including Schools, other Education establishments, Local and Central Government offices, Universities and Hospitals. A Purchase Order Number is required for each order placed as is the correct Invoice Address to complete the order process.

Non government/education companies may be given credit terms provided payment systems and guarantees are agreed between us in advance.Our standard requirement is that non government orgnaisations place three orders with us and pay for these by credit card before any account relationship can be established. To establish an account with us we will request full details of the person who will pay the invoices, full details of two credit suppliers. All such references will be checked by us before any orders on account can be supplied.

Our Standard Payment Terms for account customers are payment within 30 days. We reserve the right to add 8% of the total order value to any invoice that has not been paid in 30 days.

Any invoices outstanding after 45 days will be referred to our debt collection solicitors who will add all charges associated with collection of the debt to the total amount payable. Such charges may include any or all of the following: Letter Before Action costs, Court Fees, Bailiffs/Sheriffs Officers fees and Company Wind Up fees.

WE WILL PURSUE ALL AND ANY NON PAYMENT OF CREDIT INVOICES/BOUNCED CHEQUES/CANCELLED CREDIT CARD TRANSACTIONS THROUGH THE COURTS AND TO THE FULL EXTENT OF THE LAW UNTIL WE RECOVER GOODS TO EQUAL VALUE OF THOSE WE HAVE SUPPLIED.

ALL GOODS REMAIN THE PROPERTY OF ALPHA ENTERTAINMENT UNTIL PAID FOR IN FULL.

Return of Goods

We will accept the return of wrongly ordered goods in perfect, unused and unopened condition within 28 days of purchase and subject to inspection by us at no cost to the customer other than the cost of shipping. If the goods are not returned in pristine and ’as new’ condition we will charge a re-stocking fee to cover our losses and costs in addition to all shipping costs.

We will accept the return of goods after 28 days only upon approval of such return by the manufacturer and subsequent to their technical helpline giving us such approval in the form of an RMA number (Returned Materials Authorisation). There is no cost to the customer in these circumstances.

We will work with you and the manufacturer whose warranty is in place to achieve a satisfactory solution to any technical issue you may have for a period of 12 months after purchase.

All of the above is of course dependent upon payment having been received in full.

Your statutory rights under the sale of Goods Act 1979 (including amendments) are fully supported by Alpha Entertainment.
